The existing condition does not require the abandonment of well water access and <br />rights that the Chrismans currently enjoy. <br />Option No. 2 <br />The City Council may choose the Planning Commission-recommended Condition of <br />Approval No. 23 as follows: <br />"23. As part of the improvements for the project, the applicant shall install atwo- <br />inch water service for the benefit of the Brozosky property. The service shall <br />be installed within the right-of-way as described in Condition 24 below. The <br />applicant shall purchase and install a 6/. x'/, standard permanent water meter <br />for this new water service, shall purchase and install a reduced pressure <br />backflow device, and pay for all applicable connection fees. The water meter <br />and backflow device shall be installed within the right-of-way east of Street <br />"A" at the time the waterline is extended to the Brozosky site which shall be at <br />the same time that the applicant extends water service to either the Chrisman <br />residence or to the subdivided lots on the Chrisman property. The waterline <br />shall be shall be installed per the requirements of the City Engineer with a <br />minimum of 30 inches of cover below original grade The Chrismans shall <br />finance the construction of a two-inch PVC water line within the Brozosky <br />property and along the westerly property line of the Brozosky site from the <br />backflow device to a point of connection to the existing Brozosky residence/to <br />the existing pipeline from the well to the Brozosky residence to ensure the <br />ability to connect said temporary waterline, if needed. The exact location of <br />the two-inch water service in the dedicated right of way and the two-inch PVC <br />water line shall be shown on the improvement plans for the final map. The <br />Chrismans shall: <br />a. provide the Brozoskys notice of their intent to proceed within a one <br />year period from the date of the final map recordation. <br />b. coordinate that three bids be submitted to the City. The City shall <br />facilitate the choice of the contractor providing copies of the bids to <br />both the Chrismans and Brozoskys; Bids shall be submitted 60 days <br />before the grading permit is issued. <br />c. The Chrismans shall deposit 200 percent of the lowest bid to an <br />escrow account to construct the water line. <br />d. If the actual cost of the waterline exceeds the accepted bid, the <br />Chrismans shall be responsible for paying the increase in costs. <br />"The applicant's construction of the temporary water supply to the Brozosky <br />residence does not extinguish or eliminate any existing rights that the Chrismans <br />have in and to the existing water well on the Brozosky property. The Chrismans <br />will have continued use of the joint well per the existing rights and easements, <br />etc. <br />"This condition supersedes Condition No. 124 of PUD-05 and Condition No. 23 of <br />City Council Resolution No. 03-105. <br />Page 10 of 12 <br />
