THE PROPERTY IS LOCATED ON <br />THE SOUTH SIDE OF VINEYARD AVENUE TRAIL <br />(FORMERLY KNOWN AS 1944 VINEYARD AVENUE). <br />PROPERTY OWNERS: Kenneth and Pamela Chrisman <br />GENERAL PLAN: Vineyard Avenue Corridor Specific Plan (Low Density <br />Residential land uses) <br />ZONING: PUD (Planned Unit Development) -A/OS/LDR <br />(Agriculture/Open Space/Low Density Residential) District. <br />SUMMARY: <br />The Chrismans' 10-lot subdivision was part of Vesting Tentative Map No. 7399, <br />previously known as Centex Homes' 19-lot Apperson Ridge development (PUD-05) <br />located on the Chrismans' and Berlogars' sites at 1944 Vineyard Avenue and <br />2200 Vineyard Avenue, respectively. In June 2005, the City Council approved a PUD <br />modification (Case No. PUD-05-01 M), which separated Berlogar's nine lots from the <br />Chrisman lots and allowed the design of the nine lots that are located on the Berlogar <br />site to be changed from the approved production homes to custom homes with a set of <br />design guidelines (Silver Oaks Estates). The Berlogars have recorded the final map, <br />but the Chrisman final map has not been reviewed by the City Council. <br />In December 2006, the Chrismans filed the subject application for a similar PUD <br />modification as the Berlogars did in 2005 to use the approved Silver Oaks Estates <br />Design Guidelines and make their 10-lot development as Phase II of the Silver Oaks <br />Estates. The Brozoskys, whose family shares the existing well with the Chrismans, <br />raised concerns regarding a previously approved vesting tentative map condition that <br />the Chrismans would be allowed to continue using the well water for agricultural <br />purposes after the approval of the final map for their 10 lots and after their home is <br />connected to the City water. <br />
