25 <br />THE CITY OF <br />-'- ~ CITY COUNCIL AGENDA REPORT <br />~L£~S~4NTONe <br />August 19, 2008 '~ ~'"^w <br />Community Development Department <br />TITLE: PAP-121, PHILLIP AND JOANNA SEGUNDO, APPELLANT - <br />CONSIDER AN APPEAL OF THE PLANNING COMMISSION'S <br />APPROVAL OF AN APPLICATION FOR A CONDITIONAL USE <br />PERMIT (PCUP-205) TO RELOCATE AND REPLACE A 5,000 GALLON <br />WATER TANK IN THE REAR YARD OF THE PROPERTY LOCATED AT <br />481 SYCAMORE ROAD. <br />APPELLANT: Phillip and Joanna Segundo <br />APPLICANT: Janny Rocha <br />PROPERTY OWNER: Janny Rocha <br />SPECIFIC PLAN: North Sycamore Specific Plan <br />ZONING: PUD-A (Planned Unit Development-Agricultural) District <br />Zoning for the property is PUD-LDR (Planned Unit <br />Development -Low Density Residential) District <br />SUMMARY <br />The appellants are requesting that the City Council overturn the Planning Commission <br />approval of a conditional use permit to replace a redwood water tank with a new 5,000 <br />gallon polyurethane water tank at a different location on the subject site. The appellants <br />believe that the new tank, which has already been installed, creates a visual blight as <br />viewed from their property. <br />There is both support and opposition from surrounding neighbors related to the <br />relocation of the tank (See Attachment 3). <br />RECOMMENDATION <br />Adopt the draft resolution denying appeal PAP-121, thereby upholding the Planning <br />Commission approval of PCUP-205, subject to the conditions listed in Attachment 1. <br />FINANCIAL STATEMENT <br />The project consists of the installation of a private water tank for non-potable use on the <br />subject site. No fiscal impact on the City is anticipated. <br />
