period would expire on March 29, 1985, without any intervening <br />governmental action. <br /> <br /> F. It is in the public interest that the construction in <br />Pleasanton takes place in an orderly manner. In order to allow <br />Developer time to perfect plans and studies of the proposed <br />development of the Property, especially as it relates to <br />coordination with the proposed development of Valley Memorial <br />Hospital, it is in the public interest that the parties agree <br />that no building permits will be issued on the Property prior to <br />August 26, 1985. <br /> <br /> NOW, THEREFORE, in consideration of the mutual provisions and <br />the sum of One Thousand Dollars ($1,000.00) being paid to <br />Pleasanton as a processing fee concurrently herewith, the parties <br />agree as follows: <br /> <br /> 1. No building permits will be issued on the Property prior <br />to August 26, 1985. <br /> <br /> 2. The effect of this Agreement is to extend until <br />September 25, 1985 the time within which building permits can be <br />obtained for the Property by Developer without the expiration of <br />all or any portion of the Sewer Permits. <br /> <br /> 3. Nothing contained herein shall preclude Developer, its <br />successors-in-interest or assigns, from submitting plans and <br />development proposals for the Property to Pleasanton, including, <br />but not limited to, the submission of precise plans, subdivision <br />maps and building permit applications, during the period in which <br />the issuance of building permits is forbidden by this Agreement, <br />or at any other time. <br /> <br /> - 2 - <br /> <br /> <br />
