CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-64 <br /> <br /> ACCEPTANCE OF QUITCLAIM DEED FOR SUBTERRANEAN WATER AND <br /> QUITCLAIM OF CITY RIGHTS OF SURFACE ENTRY FOR TRACT <br /> 5117, PARKSIDE, UNIT 3 <br /> <br />WHEREAS, the City is in receipt of a Quitclaim Deed from Emerald <br /> American Corporation to the City of Pleasanton for <br /> subterranean waters, without rights of surface entry, <br /> which is given in exchange for a Quitclaim Deed from the <br /> City of Pleasanton to Emerald American Corporation for <br /> surface entry rights and easements, if any, related to <br /> the extraction of water; and <br /> <br />WHEREAS, at its meeting of February 12, 1985, the City Council <br /> received a report from the Director of Public Works and <br /> Utilities indicating that the exchange of these deeds is <br /> in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the Mayor to execute the Quitclaim Deed <br /> from the City of Pleasanton to Emerald American <br /> Corporation for surface entry rights and easements, if <br /> any, related to the extraction of water in Tract 5117, <br /> Parkside, Unit 3. <br /> <br />Section 2: Accepts a Quitclaim Deed from Emerald American <br /> Corporation to the City of Pleasanton for subterranean <br /> waters, without rights of surface entry for Tract 5117, <br /> Parkside, Unit 3, and the appropriate city officers are <br /> instructed to take whatever action necessary to <br /> implement said acceptance. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED FEBRUARY 12, 1985 BY THE FOLLOWING VOTE: <br /> <br /> <br />
