Approved as to Fqrm: <br /> <br /> Gladys 'M6usi6h,'~Deputy County Counsel <br /> <br /> LOCAL AGENCY FORMATION COMMISSION <br /> <br /> RESOLUTION NO. 84-39 <br /> <br /> WHEREAS, a resolution for application for Annexation #106 to the <br /> City of Pleasanton was heretofore filed with the Executive Officer of the <br /> Local Agency Formation Commission; and <br /> <br /> WHEREAS, said Executive Officer has reviewed said application and <br /> prepared a report, including his recommendations thereon; and <br /> <br /> WHEREAS, pursuant to the California Environmental Quality Act an <br /> Environmental ImDact Report has been prepared by the City of Pleasanton as <br /> Lead Agency, and said EIR has been considered by this Commission; and <br /> <br /> WHEREAS, imDacts identified in the Environmental Impact Report are <br /> outside the purview of this Commission and are not mitigable by this <br /> Commission; and <br /> <br /> WHEREAS, this annexation is uninhabited, not within an <br /> agricultural preserve, is within the Sphere of Influence of the City of <br /> Pleasanton, and the owner of the property requested the annexation; and <br /> <br /> WHEREAS, this Commission did find as follows: <br /> <br /> 1. The proposed annexation is consistent with the procedures and <br /> policies previously adopted by the Commission; <br /> <br /> 2. The annexation will permit the provision of municipal services <br /> by the City of Pleasanton to the subject area; <br /> <br /> 3. Pursuant to the California Environmental Quality Act, an <br /> Environmental Impact Report has been prepared by the City of <br /> Pleasanton as Lead Agency and said EIR has been considered by <br /> this Commission; and <br /> <br /> 4. The impacts identified in the EIR are outside the purview of <br /> this Commission and not mitigable by the Commission. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED THAT: <br /> <br /> Annexation #106 to the City of Pleasanton be approved subject to the following <br /> terms: <br /> <br /> 1. Correction of the map and description as may be required by <br /> the Director of Public Works, ex officio County Surveyor; and <br /> <br /> 2.
