Box 520 <br />Pleasanton, CA 94566 <br /> <br /> FIFTH ADDENDUM TO LONG-TERM AGREEMENT <br /> <br /> BETWEEN CITY OF PLEASANTON AND PONDEROSA HOMES <br /> <br /> This Fifth Addendum to Long-Term Agreement ("Fifth Addendum") <br /> <br />is made this day of , 1985 by and between PONDEROSA <br /> <br />HOMES, a general partnership ("Ponderosa"), and THE CITY OF PLEAS- <br />ANTON, a municipal corporation ("City"). <br /> <br /> 1. City and Ponderosa have heretofore made and entered into an <br />agreement entitled Long-Term Agreement dated August 24, 1982 and <br />recorded in Alameda County Records on November 23, 1982 as Series No. <br />82r178300 as amended by First Addendum and Second Addendum recorded <br />on May 3, 1983 as Series No. 83-073964 and 83-073965 respectively, <br />Third Addendum recorded September 28~ 1983 as Series No. 83-180909, <br />and Fourth Addendum and Modification to Third Addendum recorded <br />April 24, 1984 as Series No. 84-78400 (collectively the "Long-Term <br />Agreement"). Pursuant to Article I.A. of the Long-Term Agreement, <br />City granted Ponderosa growth management approval for the Project <br />(as defined in the Long-Term Agreement) including, inter alia, 75 <br />units in 1983, 150 units in 1984, and 150 units in 1985. Pursuant <br />to Article II.B of the Long-Term Agreement, building permits may be <br />granted pursuant to the Long-Term Agreement, and for utilization <br />within the time limit set forth in the Long-Term Agreement. In the <br />event of the expiration of either the growth management approval or <br />the building permits issued pursuant thereto, the growth management <br />approval so expiring may be reallocated by the City in accordance <br />with its Growth Management Program. <br /> <br /> <br />
