CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-53 <br /> <br /> RESOLUTION APPROVING APPLICATION OF CORK HARBOUR FOR <br /> MINOR MODIFICATION TO PUD-79-11 ALLOWING ADDITION OF <br /> SECOND STORIES AND ELIMINATION OF OPEN SPACE <br /> <br />WHEREAS, PUD-79-11 as originally approved included certain <br /> setback requirements for adjacent two-story residences <br /> and contained a large open space feature in the general <br /> area of an intermittent creek; and <br /> <br />WHEREAS, Cork Harbour Company, the developer of PUD-79-11, has <br /> applied for a minor modification to that PUD to allow <br /> second story additions to the original one story homes <br /> which do not change the outside dimensions of those <br /> homes in any way and to reduce the area of the open <br /> space by approximately 40% (Case PUD-79-11-4M); and <br /> <br />WHEREAS, following numerous meetings with affected homeowners and <br /> Cork Harbour Company, the current request is to delete <br /> the open space area altogether; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendation for approval of this minor modification; <br /> and <br /> <br />WHEREAS, a duly noticed public hearing was held on January 22, <br /> 1985; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Directs the Director of Planning and Community <br /> Development to approve Case PUD-79-11-4M, as modified, <br /> to allow second story additions within existing <br /> structures irrespective of setbacks and to eliminate the <br /> open space area, subject to the following conditions: <br /> <br /> 1. That a second floor may be added to any of the <br /> original one-story homes (The Bernal Model, Plan 2) <br /> in the Old Towne development as long as the outside <br /> dimensions of these homes are not changed in any <br /> way. <br /> <br /> 2. That the revised fencing for the Old Towne open <br /> space area shall be as shown on the site plan, <br /> Exhibit A, dated 1/9/85 on file with the Planning <br /> Department. <br /> <br /> 3. That approval of this case is subject to all 15 <br /> conditions contained in the letter from Cork <br /> <br /> <br />
