CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 85-14 <br /> <br /> RESOLUTION ESTABLISHING POLICY OF INCLUDING LIQUIDATED <br /> DAMAGES CLAUSES IN CITY OF PLEASANTON PUBLIC WORKS <br /> CONTRACTS <br /> <br /> WHEREAS, the timely completion of public works projects is of <br /> great importance to the City of Pleasanton and monetary <br /> damages from the delay in the completion of public works <br /> projects is extremely difficult to quantify; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: It is the policy of the City of Pleasanton to require <br /> that public works contracts include liquidated damages <br /> provisions. <br /> <br /> Section 2: City staff is directed that in the case of any public <br /> works contract which does not include a liquidated <br /> damages provision, that City staff shall direct the City <br /> Council's attention to the absence of the liquidated <br /> damages provision and include an explanation in the <br /> staff materials. <br /> <br /> Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption and shall terminate as of <br /> January 7, 1995. <br /> <br /> THIS RESOLUTION ADOPTED JANUARY 7, 1985 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Butler, Mohr, Wood and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None <br /> <br /> ATTEST: <br /> KENNETH R.
