CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-579 <br /> <br /> APPROVAL 0 GROWTH MANAGEMENT EXEMPTION FOR MOZART <br /> DEVELOPMEN'P COMPANY AND REGIS HOMES (PUD-81-22-1M) <br /> <br />WHEREAS, Mozart Dev lopment Company and Regis Homes have <br /> requested Growth Management Program exemption for <br /> certain pr,jects aimed at providing affordable housing <br /> for lower-income households; and <br /> <br />WHEREAS, the DirectDr of Planning and Community Development <br /> presented his report (SR 86:538) regarding the request <br /> from Mozar~ and Regis which analyzed the request and <br /> made several recommendations; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS <br /> <br />Section 1: Approve the application from Mozart Development <br /> Company an~ Regis Homes (PUD-81-22-1M) for a lower <br /> income exemption for the 520-unit complex, subject to <br /> the following conditions: <br /> <br /> 1. That 8 units of the 520-unit project be designated <br /> lower income units, subject to rent limitations for <br /> 10 years; <br /> <br /> 2. That occupancy of the lower income units may be in <br /> two equal phases to coincide with phased <br /> construction of the project, if any; <br /> <br /> 3. That rent and rent adjustments be set in accordance <br /> with the North Pleasanton Lower Income Exemption, <br /> allowing annual adjustments; <br /> <br /> 4. That the developer and subsequent successors shall <br /> be responsible for yearly status reports on the <br /> admiristration of the lower income units within the <br /> project. Such reports will include information on <br /> occupancy and income of tenants; <br /> <br /> 5. That the lower income exemption agreement shall run <br /> with the land; and <br /> <br /> 6. That the exemption shall lapse eighteen (18) months <br /> from the date of approval unless construction has <br /> comm~nced on any building in the project or an <br /> exte~lsion is issued by the City Council. <br /> <br /> <br />
