CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-565 <br /> <br /> RESOLUTION APPROVING THE APPEAL TO ALLOW UNDERHEIGHT <br /> DOORS AT 400 MAIN STREET <br /> <br />WHEREAS, it has come to the attention of staff that the doors at <br /> 400 Main Street do not conform to the minimum standards <br /> of the Uniform Building Code; and <br /> <br />WHEREAS, at a duly noticed public hearing on December 2, 1986, <br /> Council, acting as the Board of Appeals pursuant to <br /> Section 20.12,080 PMC, received a staff report (SR <br /> 86:521) regarding this matter and took testimony from <br /> the appellant and members of the public; and <br /> <br />WHEREAS, after a review of the material presented and <br /> considerable discussion, the City Council finds that the <br /> present height of the doors at 400 Main Street are not a <br /> significant departure from the Uniform Building Code; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the appeal of David Powell to allow the <br /> doors to stay at the height of 6'5", subject to the <br /> following conditions: <br /> <br /> 1. signage approved by the Building Official to warn <br /> of the lower door frame height shall be installed; <br /> <br /> 2. padding approved by the Building official shall be <br /> added to protect against possible head injuries; <br /> and <br /> <br /> 3. the developer shall agree to defend, indemnify and <br /> hold the City harmless from any injuries which may <br /> result from the low height of the doors. <br /> <br /> <br />
