AGREEMENT THIS AGREEMENT, made and entered into this day of November, 1986, by and between the CITY OF PLEASANTON, a municipal corporation of the State of California, hereinafter referred to as "City", and TED BEACOM, P. O. Box 91, Shingletown, california 96088, hereinafter referred to as "Contractor." WITNESSETH: WHEREAS, the City has a large amount of construction activity relating to the A. T. & T. (Site 59) project; and WHEREAS, Contractor has represented his qualifications to complete construction services for major commercial buildings such as the A. T. & T. project; and WHEREAS, Contractor is qualified to work independently of direct supervision to assure compliance with project plans and specifications; and WHEREAS, City anticipates the project schedules, size of the project, and need for unique inspection services requires Contractor ' s services; NOW, THEREFORE, in consideration of the mutual covenants, agreements, and conditions herein, the parties hereto do agree as fol lows: 1. Contractor's Services. Contractor shall diligently perform the services and furnish the materials and equipment hereinafter set forth. a. Provide construction inspection services on the A. T. & T. project as assigned by the Director of Building Inspection, or his designated representative, including keeping adequate notes and records. b. Provide adequate training to City building inspectors to do on site inspections. c. Provide adequate transportation to travel as necessary to and from all job assignments along with evidence of insurance coverage satisfactory to the City attorney 2. Ownership of Work. All notes, reports, and records prepared by the Contractor under this contract shall be considered the property of the City of Pleasanton, and upon request, at the completion of the services to be performed, they will be turned over to the City of Pleasanton. - 1 -
