Section 6. To make any and all arrangements that may be <br />necessary to secure the location or relocation of wire lines, <br />pipelines and other facilities owned by private persons, com- <br />panies, corporations, political subdivisions, or public utilities <br />other than the Railroads which are required to be located or <br />relocated in any manner whatsoever due to the construction of <br />the underpass and its appurtenances. <br /> <br /> Section 7. To construct the underpass and retaining walls <br /> <br />and to provide for suitable drainage as provided for in the plans <br /> <br />and specifications for the underpass. <br /> <br /> Section 8. To furnish all-labor, materials, tools and <br /> <br />equipment and all other items necessary to do the work City <br />herein agrees to do. To do all work called for in its part in <br />such manner as not to interfere with the safe and timely operation <br />of the Railroads. <br /> <br /> Section 9. All work of the City and its contractor con- <br />templated by this agreement, including such maintenance of the <br />underpass as is the responsibility of the City, shall be performed and <br />accomplished without interruption to or delay of operations of the <br />Railroads or of others lawfully occupying or using their property or <br />facilities, and without interruption to or delay of continuous railroad <br />traffic. It is understood and recognized that safety and continuity <br />of railroad operations and communications are of the utmost importance, <br />and in order that the same may be adequately safeguarded, protected <br />and assured, and in order that accidents may be prevented and avoided, <br /> <br /> 6 <br /> <br /> <br />
