RESOLUTION NO. 08-222 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />CERTIFYING THAT CITY ASSESSMENTS COMPLY WITH PROPOSITION 218 <br />WHEREAS, every year cities (and some special districts) throughout Alameda County <br />request the County to place on the property tax rolls taxes and assessments that the cities and <br />the special districts have levied; and <br />WHEREAS, because of Proposition 218 concerns, the County Auditor has requested the <br />requesting agencies (1) to certify that the taxes and assessments that are to be placed on the <br />2008/2009 tax roll meet the requirements of Proposition 218, and (2) to indemnify the County <br />should there be a challenge to the tax or assessment on grounds that it doesn't comply with the <br />requirements of Proposition 218; and <br />WHEREAS, because City staff has discussed these various assessments at length with <br />the City Council in context of Proposition 218 and because the Council has taken action to <br />continue to levy these various assessments, the City is satisfied that the assessments that it has <br />requested the County to place on the 2008/2009 tax rolls meet the requirements of Proposition <br />218. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />Section 1: The City Council certifies to the County of Alameda that the assessments <br />that the City will request the County to place on the 2008/2009 tax roll meet the requirements of <br />Proposition 218 and that the City Attorney is authorized to sign the attached Certification and <br />Indemnification Agreement. <br />Section 2: This resolution shall become effective immediately upon its passage and <br />adoption. <br />Section 3: City Clerk shall certify to the passage of this resolution and enter it into the <br />book of original resolutions. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br />a regular meeting held on July 15, 2008. <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 15th day of July, <br />2008, by the following vote: <br />Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thor ,Mayor Hosterman <br />Noes: None <br />Absent: None <br />APPROVED AS TO FOR <br />i~C Cat (~i.~ <br />are Diaz, City CI <br />Michael H.
