LICENSE AGREEMENT <br /> <br /> THIS AGREDIF.~T is made as of _C:~JO+~ q , 1986, between EAST <br /> BAY REGIONAL PARK DISTRICT, a California special district, ("Licensor"), <br /> whose address is 11500 Skyline Boulevard, Oakland, California 94619, <br /> Attention: General Manager, and CITY OF PLEASANTON, a California municipal <br /> corporation, ("Licensee"), whose address is P. O. Box 520, Pleasanton, <br /> California 94566-0802, who agree as follows: <br /> <br /> 1. RECITALS. This Agreement is made with reference to the following <br /> facts and objectives: <br /> <br /> 1.1. Licensor is the fee owner of that certain real property in <br /> the unincorporated areas of the County of Alameda, State of California, <br /> shown on Exhibit "A", attached hereto and made a part hereof. <br /> <br /> 1.2. Licensee wishes to assume maintenance responsibility for a <br /> proposed storm drain and outfall structure and access road thereto, all as <br /> shown on said Exhibit "A". <br /> <br /> 2. GRANT OF LICENSE. Licensor grants to Licenseea license to come <br />onto the License Area solely for the purposes of (a) installing, <br />maintaining, operating and repairing said storm drain, outfall structure <br />and access route and such related appurtenances as are reasonably <br />necessary, in Licensee's discretion; (b) removal of the pipeline upon <br />termination hereof, and (c) restoration of the land as provided herein. <br /> <br /> 3. TERM. Subject to the provisions of Section 6, the term of the <br />license shall be 25 years, commencing on the date of this Agreement; <br />provided, that if within i0 days of each anniversary of the execution of <br />this Agreement neither party gives written notice of intent to terminate <br />the license at the end of 25 years, then the license shall be automatically <br />renewed and continued in full force and effect for a period of 25 years from <br />such anniversary date. <br /> <br /> 4. CONDITIONS ON USE OF LICENSE AREA. The license shall be subject <br />to the following conditions: <br /> <br /> 4.1 Materials. Storm drain outfall and access route shall be <br />constructed as sho~n on said attached Exhibit "A". <br /> <br /> 4.2 Installation. The facilities shall be installed as required <br />in E.B.R.P.D. Encroachment Permit No. 7E-86-81, issued 7-23-86, and an <br />additional permit to be required prior to granting this license. <br /> <br /> 4.3 Laws~ Safety~ Permits. Licensee at its cost shall comply <br />with all present and future laws, ordinances, rules and regulations <br />concerning Licensee's use of the License Area, including, without <br />limitation, health and safety laws. Licensee agrees to comply with <br />Licensor's reasonable requests for health and safety precautions on the <br />License Area. <br /> <br /> <br />
