LICENSE AGREEMENT THIS AGREEMENT is made as of ~~ ~ , 1986, between EAST BAY REGIONAL PARK DISTRICT, a California special district, ("Licensor"), whose address is 11500 Skyline Boulevard, Oakland, California 94619, Attention: General Manager, and CITY OF PLEASANTON, a California municipal corporation, ("Licensee"), whose address is P. O. Box 520, Pleasanton, California 94566-0802, who agree as follows: 1. RECITALS. This Agreement is made with reference to the following facts and objectives: 1.1. Licensor is the fee owner of that certain real property in the unincorporated areas of the County of Alameda, State of California, shown on Exhibit "A:, attached hereto and made a part hereof. 1.2. Licensee wishes to assume maintenance responsibility for a proposed 30 inch storm drain, all as shown on said Exhibit "A". 2. GRANT OF LICENSE. Licensor grants to Licensee a license to come onto the License Area solely for the purposes of (a) installing, operating and repairing said storm drain pipe, and such related appurtenances as are reasonably necessary, in Licensee's discretion; (b) removal of the pipeline upon termination hereof, and (c) restoration of the land as providea herein. 3. TERM. Subject to the provisions of Section 6, the term of the license shall be 25 years, commencing on the date of this Agreement; provided, that if within 10 days of each anniversary of the execution of this Agreement neither party gives written notice of intent to terminate the license at the end of 25 years, then the license shall be automatically renewed and continued in full force and effect for a period of 25 years from such anniversary date. 4. CONDITIONS ON USE OF LICENSE AREA. The license shall be subject to the following conditions: 4.1 Materials. Storm drain pipe shall be constructed as shown on said attached Exhibit "A". 4.2 Installation. The facilities shall be installed as required in E.B.R.P.D. Encroachment Permit No. 15E-86-81, issued 8-13-86, and an additional permit to be required after detailed construction plans are made available by Permittee. 4.3 Laws; Safety~ Permits. Licensee at its cost shall comply with all present and future laws, ordinances, rules and regulations concerning Licensee's use of the License Area, including, without limitation, health and safety laws. Licensee agrees to comply with Licensor's reasonable requests for health and safety precautions on the License Area.
