WHEREAS, by Resolution 83-52 of the City Council of the <br />City of Pleasanton adopted February 8, 1983 the Land <br />Conservation Contract was tentatively cancelled and a <br />Certificate of Tentative Cancellation pursuant to the <br />California Land Conservation Act of 1965 was issued by <br />Robert J. Harris, Director of Planning and Community <br />Development and recorded in the Official Records of <br />Alameda County on May 4, 1983; and <br /> <br />WHEREAS, on February 7, 1984 all conditions and <br />contingencies set forth in the Certificate of Tentative <br />Cancellation recorded May 4, 1983 were complied with by <br />payment to the County of Alameda of the cancellation <br />fee in the amount of $27,625.00; and <br /> <br />WHEREAS, on June 17, 1986 the City Council of the City <br />of Pleasanton issued its Certificate of Final <br />Cancellation pursuant to the California Land <br />Conservation Act of 1965; and <br /> <br />WHEREAS, pursuant to the provisions of Section 51280 et <br />seq., of the Government Code of the State of <br />California, Lund did file a timely request for <br />cancellation of the Land Conservation Contract covering <br />its property located in Agricultural Preserve 1974-15 <br />in accordance with Section 51282 of the Government Code <br />of the State of California without prejudice to the <br />prior cancellation in accordance with Section 51282.1 <br />of the Government Code of the State of California <br />repealed by Statutes 1981, c.1095, Section 9, operative <br />January 1, 1983; and <br /> <br />WHEREAS, the City Council of the City of Pleasanton has <br />considered the aforementioned cancellation request <br />together with the reports of the Planning Department <br />and City Attorney of the City of Pleasanton thereon and <br />evidence offered by the applicant; and <br /> <br />WHEREAS, this application has been reviewed in <br />accordance with the provisions of the California <br />Environmental Quality Act and a negative declaration <br />has been prepared, considered and adopted for this <br /> <br /> <br />
