WHEREAS, by Resolution 83-52 of the City Council of the City of Pleasanton adopted February 8, 1983 the Land Conservation Contract was tentatively cancelled and a Certificate of Tentative Cancellation pursuant to the California Land Conservation Act of 1965 was issued by Robert J. Harris, Director of Planning and Community Development and recorded in the Official Records of Alameda County on May 4, 1983; and WHEREAS, on February 7, 1984 all conditions and contingencies set forth in the Certificate of Tentative Cancellation recorded May 4, 1983 were complied with by payment to the County of Alameda of the cancellation fee in the amount of $27,625.00; and WHEREAS, on June 17, 1986 the City Council of the City of Pleasanton issued its Certificate of Final Cancellation pursuant to the California Land Conservation Act of 1965; and WHEREAS, pursuant to the provisions of Section 51280 et seq., of the Government Code of the State of California, Lund did file a timely request for cancellation of the Land Conservation Contract covering its property located in Agricultural Preserve 1974-15 in accordance with Section 51282 of the Government Code of the State of California without prejudice to the prior cancellation in accordance with Section 51282.1 of the Government Code of the State of California repealed by Statutes 1981, c.1095, Section 9, operative January 1, 1983; and WHEREAS, the City Council of the City of Pleasanton has considered the aforementioned cancellation request together with the reports of the Planning Department and City Attorney of the City of Pleasanton thereon and evidence offered by the applicant; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and a negative declaration has been prepared, considered and adopted for this
