7. Permittee shall, on receipt of notice to do so and within such reasonable time limits as may he fixed by said <br /> notice, alter or reinova at his own expense any of his improvements, pX~ntlngs. or other property to such <br /> tent as may be required to avoid interference with any of City's pipe, power lines, or other structures now or <br /> hereafter to be constructed. with the maintenance thereof. or ~vith any other operations or load use by CIty. <br /> In the event Permittee falls to alter or remove any of his intprovements, plantlags, or other property within <br /> the time limit specified in said notice, said hnprovements. plant~gs, or other property may be removed by City, - <br /> the reasonable expense of which shall be paid to City by Permittee. <br /> 8. In the event of any emergency CIty may. at Its sole option and without notice. alter, remove or protect at Per- <br /> mittee's expense, any improvements, plantinge, or other property. except utility facilities owned either by a <br /> private company or a public agency. On notice that an emergency exists, owners of utility facilities, at their <br /> own expense, must take immediate action to protect, remove or relocate such ,facilities as required to meet <br /> the emergency. <br /> 9. Permittee shall be responsible and liable for any and all damage to City's structures or property. due directly <br /> or indirectly to Permlttee's occupation and use ol City lands pursuant to title permit, and shall promptly pay <br /> any Just claim therefor. Permittee shall asstame the defense of and indemnify m~d save harmless the City and <br /> County of San Francisco, its Public Utilities Commission, oftleers, and employees from all claims, loss, liens, <br /> damage, injury and liability of every kind. nature a~d descripLlon, directly or indirectly arising from Permit- <br /> tee's occupation and use of CIty lands pursuant to tiffs permit regardless of responsibility for negligence. <br /> 10. Any garden[rig or landscaping shah be limited to low growing shrubs, grass or plants. Planting of trees on <br /> pipeline or electric line rights-of-way Is expressly not permitted. <br /> 11. To the extent that any special conditions set forth herein conflict with or are inconsistent with the printed <br /> conditions, the special conditions shall prevail. <br /> 12. In the event the purpose of this permit is to allow Permittee to install utility facilities underground across <br /> Ctty's premises, the clear dL~tance between the bottom of Permittee's installation and the top of C[ty's existing <br /> and proposed future water lines shall not be less than six inches and Permittee's said installation shall be placed <br /> at an approximately constant grade for the entire erossing. <br /> 13. In the event the purpose of this permit is to allow Permittee to h~stall utility facilities underground across <br /> City's premises, Permittee shall properly mark the alignment of the underground installation with witness <br /> posts. <br /> 14. All conditions of this permit ar'e subject to periodic x'e~.~','. <br /> <br /> 15. This permit grants right-of-access to Permittee over lands of City <br /> as shown in City's Drawing B-4436 and as described in Exhibits A & <br /> B attached and made a part hereof; for the purpose of constructing <br /> storm drainage facilities; the rights hereby granted are subject <br /> to the following two conditions: <br /> <br /> Condition 1 -- Permittee shall hereafter secure from City an <br /> easement for flood control purposes by purchase, <br /> exchange, and/or by other means for the land <br /> described above; all within 18 months from the <br /> date of issuance of this permit. <br /> <br /> Condition 2 -- That the City, its successor and assigns shall <br /> not be assessed for any and all cost for storm' <br /> drainage facilities <br /> ~kE~ of which the storm drainage facilities to <br /> be constructed under this permit is a part. <br /> <br /> 16. Prior to construction of facilities, Permittee shall submit con- <br /> struction plan for approval by the City. <br /> <br /> 17. The Permittee shall notify the Manager of the Suburban Division of <br /> the San Francisco Water Department, phone 697-4424, five working <br /> days prior to the date of construction. <br /> <br /> 18. Construction work shall be limited to the area covered under this <br /> permit. Permittee shall not use the adjacent lands of the City <br /> without prior approval of the General Manager of the San Francisco <br /> Water Department. <br /> <br /> 19. The construction authorized by this permit is subject to City's in- <br /> spection and approval. <br /> <br /> 20. The City reserves the right to alter, add, and delete from the work <br /> .authorized or required under this permit. <br /> <br />· 21. Permittee shall not accept and release his Contractor for the work <br /> authorized or required by this permit before securing the approval <br /> of the City. <br /> <br /> 22. Upon completion of construction permitted hereunder, Permittee shall <br /> remove all debris and excess dirt and restore the City's land to <br /> their original condition to the satisfaction of the General Manager <br /> of the San Francisco Water Department. <br /> <br /> F-3940-2 <br /> <br /> <br />
