CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-436 <br /> <br /> RESOLUTION OF INTENTION TO DISCONTINUE PARK USE - AREA <br /> NORTH OF MISSION HILLS PARK <br /> <br />WHEREAS, the City of Pleasanton finds that all of the land <br /> described in Exhibit "A" attached hereto has not been <br /> used by the public for park purposes because of the <br /> unsuitability of the land for park purposes; and <br /> <br />WHEREAS, the City finds that no consideration has been paid for <br /> the land, except by the City; and <br /> <br />WHEREAS, the City finds no public funds have been expended to <br /> improve the land as a park in either of the following <br /> situations: <br /> <br /> a. the subject land has been dedicated for park <br /> purposes by the recording of a plat or map in the <br /> County Recorder's office, or otherwise; <br /> <br /> b. the subject land has been purchased for park <br /> purposes and the City Council finds that the <br /> subject land is not appropriate, convenient, nor <br /> necessary for park purposes; <br /> <br />WHEREAS, the City intends to discontinue the park described in <br /> Exhibit "A"; and <br /> <br />WHEREAS, Government Code Section 38503 requires notice of <br /> intention to be published; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby adopts a resolution of <br /> intention, pursuant to Government Code Section 38503, to <br /> abandon the land described in Exhibit "A", proposed for <br /> park use. <br /> <br />Section 2: The City Clerk shall publish this resolution of <br /> intention once a week for three (3) successive weeks, <br /> setting the place and time for hearing objections to <br /> discontinuance of the park as follows: Place - City <br /> Hall, 200 Old Bernal Avenue, Time - October 28, 1986, at <br /> 8:00 p.m. <br /> <br />Section 3: The City Manager or his agent is directed to post <br /> conspicuously not less than four (4) copies of this <br /> resolution, not more than one hundred (100) feet apart <br /> <br /> <br />
