BACKGROUND The current Development Impact Fee Report was completed in September 1998 and included the restructuring of four existing development impact fees and the creation of a Public Facilities Fee and Traffic Development Fee. The Traffic Development Fee was designed to assure that future development contributes its fair share toward the cost of traffic improvements necessary for build-out of the 1996 General Plan. The 1996 General Plan and Circulation Element were used to identify needed traffic mitigation measures and facilities to accommodate projected growth. Projects identified in the Circulation Element formed the basis for the Traffic Development Fee. The fee amount was calculated by dividing the sum of all project costs by the number of new peak hour trips anticipated from new development. The City Council is in the final stages of the update to the 1996 General Plan. The update includes comprehensive changes to the existing Circulation Element. The proposed Circulation Element identifies new projects not included in the Traffic Development Fee program. There are also projects in the 1996 General Plan that are either no longer applicable or have been removed from the proposed General Plan. As a result, the existing fee program is not sufficient to adequately fund the necessary transportation infrastructure needed to support development. DISCUSSION In anticipation of an approved General Plan and Circulation Element, staff solicited proposals for an update to the Traffic Development Impact Fee. The scope of work for the update included the following items: • Develop an impact fee based on the City's 2030 General Plan's transportation network which includes roadway, transit, bicycle, and pedestrian facility improvements. • Create and update engineering cost estimates for these improvements. • Prepare a financing plan and nexus study, analyzing the relationships between anticipated land uses, costs and fees. • Develop new fee rates (Consultant will consider the City Council's policies in support of infill development, affordable housing, and the housing cap). • Recommend methodologies for ongoing administration of the Transportation Development Impact Fee Program including fee adjustments, implementation of the program and administrative responsibilities required by the program. • Review and update the City's Transportation Development Impact Fee Ordinance. • Conduct extensive public outreach to develop stakeholder consensus. City staff advertised a Request for Proposal for the fee update in April 2008. Staff received five proposals from qualified consultants. Based on the initial response to the scope of work, staff selected two consultants to participate in an oral interview. TJKM Transportation Consultants of Pleasanton was identified as the preferred consultant for the project. TJKM has prepared similar fee updates for other jurisdictions in the East Page2of3
