Hopyard owns certain real property ('Original <br />Parcel~) located in the City of Pleasanton, County of <br />Alameda, State of California, consisting of approximately <br />4.5 acres at the northeast corner of Hopyard Road and Valley <br />Avenue and comprising Assessor's Parcels Numbered <br />946-3215-15 through 21, inclusive, and an adjacent 1.56 acre <br />parcel ("Development Parcel"), Assessor's Parcels Numbered <br />946-3215-11, 12 and 14 (collectively, "Hopyard Center"), <br />more particularly described in Exhibit A attached hereto. <br /> <br /> B. The Alameda County Flood Control and Water <br />Conservation District, Zone 7 ("Zone 7") owns certain real <br />property ("Pleasanton Canal") improved as a drainage canal, <br />adjacent to Hopyard Center. <br /> <br /> C. The City and Hopyard entered into an In-Lieu <br />Parking Agreement ("In-Lieu Parking Agreement") dated <br />May 21, 1985, in order to permit Hopyard to finish leasing <br />existing building space in the Original Parcel pending <br />completion of arrangements for construction of a parking <br />area over a portion of the Pleasanton Canal ("Canal Easement <br />Area") on property to be acquired by the City· The Canal <br /> <br /> K559-26-A/08Sep86/a <br /> <br /> <br />
