21, inclusive, and an adjacent 1.56 acre parcel, Assessor's <br />Parcels Numbered 946-3215-11, 12 and 14 (collectively, <br />"Hopyard Center"), as more particularly described on Exhi- <br />bit 1, attached hereto. <br /> <br /> B. On November 5, 1985, City approved a Planned <br />Unit Development ("PUD-85-10") for Hopyard Center, by <br />Ordinance No. 1227. PUD-85-10 makes development of the <br />Hopyard Center as described therein contingent Upon receipt <br />of legal assurances that Hopyard will construct an automo- <br />bile parking structure ("Parking Facility") providing cer- <br />tain parking spaces over the Pleasanton Canal on property <br />adjacent to Hopyard Center. <br /> <br /> C. City owns and proposes to acquire interests in <br />the Pleasanton Canal ("Canal Area") easterly of Hopyard Road <br />and adjacent to Hopyard Center. The Canal Area is further <br />described on Exhibit 2, attached hereto. Hopyard now <br />desires to grant to City a Secondary Access Easement to the <br />Parking Facility and to the Canal Area, and City desires to <br />accept the same, upon the terms and conditions set forth <br />herein. <br /> <br /> NOW T~EREFORE, IN CONSIDERATION of the mutual <br />covenants and promises of the parties, the parties hereto <br />agree as follows: <br /> <br /> o <br /> <br /> K559-26-E/31Ju186/a <br /> <br /> <br />
