MODIFICATION OF AGREEHENT <br /> <br /> The County of Alameda (heretnafter referred to as COUNTY) and the Ctty of <br />Pleasanton (heretnafter referred to as CITY) hereby agree as follows: <br /> <br />Recttals and Purposes <br /> <br /> Thts Hodtftcatton of Agreement ts made in ltght of the following facts and <br />to accomplish these purposes: <br /> <br /> a. COUNTY and CITY entered into an Agreement on July 15, 1986, (C-86-250) <br /> for CITY to dtspose of approxtnmtely 70,000 cubic y~rds of excavated <br /> matertal from CITY's project for extension of Valley Avenue, said <br /> excavated matertal to be deposited on COUNTY's property tn the vicinity <br /> of Stanley Boulevard at COUNTY expense. <br /> <br /> b. CITY is desirous of reducing the quanttty of excavated matertal to be <br /> .deposited on COUNTY's property, and COUNTY wtll benefit by Incurring <br /> reduced costs and by preserving additional capacity for flood control <br /> deposition of matertal removed from streams in the future. <br /> <br />Modification <br /> <br /> COUNTY and CITY agree to modify the agreement dated July 15, 1986, (C-86-250) <br />as follows: <br /> <br /> a. Paragraph I.D is amended to read as follows: <br /> <br /> I.O CITY currently has a project for the extension of Valley Avenue <br /> and the widening of Stanley Boulevard in the vicinity of said <br /> COUNTY-owned property, which project will generate excess excavated <br /> material. Since it is mutually beneficial to CITY to dispose of <br /> some of the excavated material at a nearby site and for COUNTY to <br /> have said material deposited and compacted on COUNTY's future <br /> building site (designated Fill Site A) on COUNTY property which is <br /> adjacent to CITY's project, CITY has agreed to have CITY's contrac- <br /> tor for the Valley Avenue extension do the following. The contrac- <br /> tor for CITY shall provide, place, spread, and compact all available <br /> excavated material that is required to completely fill Site A to <br /> the lines and grades shown on the drawing titled, 'Stanley Boulevard <br /> Disposal Sites for Embankment Construction.' Said quantity is <br /> estimated not to exceed 16,000 cubic yards. COUNTY agrees to com- <br /> pensate CITY for said work done by its contractor. <br /> <br /> b. Paragraph III.A is amended to read as follows: <br /> <br /> III.A Payment for placing and compacttng said excavated mtertal shall <br /> be at.the btd prtce for Bid Item No. 108, "Spread and Compact <br /> Excavated Material on Disposal Sites A and B (90% Compaction)," <br /> which is $0.70 per cubic yard. Payment for Btd Item No. 107, <br /> "Clear and Grub Disposal Sites A and B (COUNTY property)," shall <br /> be for Site A only and shall exclude Site B and shall be for a <br /> lump sue price of $2,750.00. Both the above items refer to CITY's <br /> Addendue No. 1 Proposal dated June 23, 1986, for CITY Project A.D. <br /> 1986-1. <br /> <br /> <br />
