CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 86-379 RESOLUTION AMENDING THE LAVWMA SEWER SERVICE AGREEMENT WHEREAS, on February 1, 1978 LAVWMA, District, Livermore, and Pleasanton entered into an agreement for the provision by LAVWMA of sewer service to its member agencies and the payment by the member agencies for those services and; WHEREAS, since the execution of that agreement changes have occurred in the amount of capacity provided to the member agencies due to incremental expansions of LAVWMA's facilities, to the allocation of costs between the member agencies and the business address of LAVWMA; and; WHEREAS, the completion of the 4.38 million gallons per day (MGD) expansion of LAVWMA's export capacity in the near future requires an amendment to the February 1, 1978 Sewer Service Agreement in order to reflect the changes that have occurred over the years and the changes that will occur as a consequence of the aforementioned expansion. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Section 3.03(b) is amended to reflect the present allocation of maximum sewer service LAVWMA is currently required to provide Pleasanton as 6.~48 MGD. Section 2: Upon completion and acceptance by LAVWMA of the 4.38 MGD expansion, the allocation under Section 3.03(b) shall be 7.506 MGD. Section 3: The Fixed Cost Allocations set forth in Section 4.01 are amended to reflect the current allocation and the allocation upon completion and acceptance of the 4.38 MGD expansion. Currently, Pleasanton is 36.99 percent. After 4.38 MGD expansion, 35.74 percent. Section 4: Except as expressly modified herein, the terms and conditions of the February 1, 1978 Sewer Service Agreement shall remain in full force and effect. Section 5: This resolution shall become effective immediately upon its passage and adoption.
