CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-379 <br /> <br /> RESOLUTION AMENDING THE LAVWMA SEWER SERVICE AGREEMENT <br /> <br />WHEREAS, on February 1, 1978 LAVWMA, District, Livermore, and <br /> Pleasanton entered into an agreement for the provision <br /> by LAVWMA of sewer service to its member agencies and <br /> the payment by the member agencies for those services <br /> and; <br /> <br />WHEREAS, since the execution of that agreement changes have <br /> occurred in the amount of capacity provided to the <br /> member agencies due to incremental expansions of <br /> LAVWMA's facilities, to the allocation of costs between <br /> the member agencies and the business address of LAVWMA; <br /> and; <br /> <br />WHEREAS, the completion of the 4.38 million gallons per day (MGD) <br /> expansion of LAVWMA's export capacity in the near future <br /> requires an amendment to the February 1, 1978 Sewer <br /> Service Agreement in order to reflect the changes that <br /> have occurred over the years and the changes that will <br /> occur as a consequence of the aforementioned expansion. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Section 3.03(b) is amended to reflect the present <br /> allocation of maximum sewer service LAVWMA is currently <br /> required to provide Pleasanton as 6.~48 MGD. <br /> <br />Section 2: Upon completion and acceptance by LAVWMA of the 4.38 <br /> MGD expansion, the allocation under Section 3.03(b) <br /> shall be 7.506 MGD. <br /> <br />Section 3: The Fixed Cost Allocations set forth in Section 4.01 <br /> are amended to reflect the current allocation and the <br /> allocation upon completion and acceptance of the 4.38 <br /> MGD expansion. Currently, Pleasanton is 36.99 percent. <br /> After 4.38 MGD expansion, 35.74 percent. <br /> <br />Section 4: Except as expressly modified herein, the terms and <br /> conditions of the February 1, 1978 Sewer Service <br /> Agreement shall remain in full force and effect. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
