C ~ <br />and cocktail lounges it may be necessary for them to reduce floor <br />space in the center, perhaps by eliminating one of the buildings <br />not yet constructed. In the alternative, the hours during which <br />the lounge would be open could be regulated so that parking spaces <br />not in .use in the evening would be available for lounge customer <br />parking. The staff is afraid, however, that neither of these <br />alternatives would be feasible in this case because of enforcement <br />problems. As well, the applicant has indicated that seating much <br />below the figure of 90 would not be economically feasible. <br />Staff Recommendation: The staff recommends denial of UP-80-35 as <br />proposed. If your Commission does not concur, we recommend that <br />approval be accompanied by the following conditions: <br />1. That this approval is for an approximately 2500 sq. ft. or <br />smaller cocktail lounge at the subject location shown on <br />the attached site plan with a maximum of 90 seats. The <br />lounge shall be operated only between the hours of 5:00 P.M. <br />and 2:00 A.M. <br />2. That the applicant and Hopyard Center owners acknowledge <br />in writing that they are aware that upon violation of <br />any of the conditions of this use permit, the permit is <br />subject to immediate suspension and that it may be revoked <br />after a public hearing as stipulated in Section 2-11.14, <br />Article 25 of the Zoning Code of the City of Pleasanton. <br />3. That any and all signs on the property must be in con- <br />formance to a comprehensive sign program for the center <br />to be approved by the City. <br />4. That a rear exit shall be supplied from the lounge and <br />any tenant improvements shall be subject to building <br />permits. <br />5. That if required by the Police Department, a suitable <br />security alarm system shall be installed on the premises. <br />b. That a fire permit be secured by the applicant from the <br />City Fire Department based upon tenant improvement plans <br />to be submitted for review. <br />If your Commission approves this use permit, the staff suggests <br />that you make the following findings required for the granting <br />of a use permit prior to such approval: <br />A. That the proposed location of the conditional use is in <br />accord with the objectives of the zoning ordinance and the <br />purposes of the district in which the site is located.. <br />-2- <br />
