C ~
and cocktail lounges it may be necessary for them to reduce floor
space in the center, perhaps by eliminating one of the buildings
not yet constructed. In the alternative, the hours during which
the lounge would be open could be regulated so that parking spaces
not in .use in the evening would be available for lounge customer
parking. The staff is afraid, however, that neither of these
alternatives would be feasible in this case because of enforcement
problems. As well, the applicant has indicated that seating much
below the figure of 90 would not be economically feasible.
Staff Recommendation: The staff recommends denial of UP-80-35 as
proposed. If your Commission does not concur, we recommend that
approval be accompanied by the following conditions:
1. That this approval is for an approximately 2500 sq. ft. or
smaller cocktail lounge at the subject location shown on
the attached site plan with a maximum of 90 seats. The
lounge shall be operated only between the hours of 5:00 P.M.
and 2:00 A.M.
2. That the applicant and Hopyard Center owners acknowledge
in writing that they are aware that upon violation of
any of the conditions of this use permit, the permit is
subject to immediate suspension and that it may be revoked
after a public hearing as stipulated in Section 2-11.14,
Article 25 of the Zoning Code of the City of Pleasanton.
3. That any and all signs on the property must be in con-
formance to a comprehensive sign program for the center
to be approved by the City.
4. That a rear exit shall be supplied from the lounge and
any tenant improvements shall be subject to building
permits.
5. That if required by the Police Department, a suitable
security alarm system shall be installed on the premises.
b. That a fire permit be secured by the applicant from the
City Fire Department based upon tenant improvement plans
to be submitted for review.
If your Commission approves this use permit, the staff suggests
that you make the following findings required for the granting
of a use permit prior to such approval:
A. That the proposed location of the conditional use is in
accord with the objectives of the zoning ordinance and the
purposes of the district in which the site is located..
-2-
