PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1974 <br />A RESOLUTION OF THE PLANNING COMMISSION INITIATING <br />AN APPLICATION FOR AN ORDINANCE CODE CHANGE. <br />WHEREAS, current provisions of the zoning ordinance limit the <br />effective period of approval of variances, conditional <br />use permits and design review to one year; and <br />WHEREAS, unless a building permit is issued within that period, <br />or in the case of a use permit, a certificate of occupancy <br />is granted, the approval lapses one year after the <br />effective date of action by the Planning Commission, <br />Design Review Board or Board of Adjustment; and <br />WHEREAS, as a result of these provisions the City has been faced <br />with reapproving some projects simply because financing <br />for the development took most or all of the year given <br />to secure a building permit; and <br />WHEREAS, it is probably necessary to limit the period of effective <br />approval because of the possibility of unforeseen changes <br />_ such as development on adjacent or other nearby land, <br />city policies, or other factors; and <br />WHEREAS, in all cases, it may not be necessary to subject the <br />project to the full Design Review Board, Board of <br />Adjustment or Planning Commission review procedures; and <br />WHEREAS, there may be several ways to modify the one year lapse <br />provision in order to facilitate efficient processing of <br />projects and still account for changes that might affect <br />development. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. The staff is requested to draft an ordinance and initiate <br />an application for zoning ordinance amendment. The pro- <br />posed ordinance amendment shall be prepared for review <br />at a future Planning Commission meeting. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City of Pleasanton <br />on the 18th day of March 1981 by the following vote: <br />/// <br />
