PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 1974 A RESOLUTION OF THE PLANNING COMMISSION INITIATING AN APPLICATION FOR AN ORDINANCE CODE CHANGE. WHEREAS, current provisions of the zoning ordinance limit the effective period of approval of variances, conditional use permits and design review to one year; and WHEREAS, unless a building permit is issued within that period, or in the case of a use permit, a certificate of occupancy is granted, the approval lapses one year after the effective date of action by the Planning Commission, Design Review Board or Board of Adjustment; and WHEREAS, as a result of these provisions the City has been faced with reapproving some projects simply because financing for the development took most or all of the year given to secure a building permit; and WHEREAS, it is probably necessary to limit the period of effective approval because of the possibility of unforeseen changes _ such as development on adjacent or other nearby land, city policies, or other factors; and WHEREAS, in all cases, it may not be necessary to subject the project to the full Design Review Board, Board of Adjustment or Planning Commission review procedures; and WHEREAS, there may be several ways to modify the one year lapse provision in order to facilitate efficient processing of projects and still account for changes that might affect development. NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: Section 1. The staff is requested to draft an ordinance and initiate an application for zoning ordinance amendment. The pro- posed ordinance amendment shall be prepared for review at a future Planning Commission meeting. Section 2. This resolution shall become effective immediately upon its passage and adoption.
