PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1824 <br />A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR <br />HENRY CUPPLES FILED UNDER PUD-79-12 <br />WHEREAS, Henry Cupples has applied for development plan approval for <br />a restaurant to be located on a 0.9 acre portion of a 6.1 <br />acre site located at the southeast corner of Hopyard Road <br />and I-580. The honing for the property if PUD (Planned <br />Unit Development) District; and <br />WHEREAS, the Planning Commission took public testimony concerning <br />this rezoning and reviewed all reports and exhibits; and <br />WHEREAS, said proposal was based upon an Initial Study done pursuant <br />to the Environmental Impact Guidelines and Procedures adopted <br />by the City Council of the City of Pleasanton by Resolution <br />No. 77-66; and <br />WHEREAS, the Planning Commission, at its meeting of November 14, 1979, <br />received the~Initial Study and proposed Negative Declaration <br />-- in a report from the Director of Community Development dated, <br />November 8, 1979, regarding the aforementioned project; and <br />WHEREAS, the Planning Commission was advised by the City Attorney of <br />its responsibilities in reviewing the proposed Negative <br />Declaration and the determinations required by Section 5.4(e) <br />of Resolution No. 77-66; and <br />WHEREAS, each member of the Planning Commission had before him/her <br />copies of Resolution No. 77-66 at the time of considering <br />the proposed environmental assessment, which has previously <br />been published in the Pleasanton Times, at the time of the <br />public hearing of the aforementioned project; and <br />WHEREAS, upon receipt of the staff report and public input, the <br />Planning Commission reviewed the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation of <br />projects and the preparation of Environmental Impact Reports <br />as they pertain to requirements for Negative Declarations and <br />Environmental Impact Reports in order to determine if a <br />Negative Declaration is appropriate for the project and what <br />mitigation measures, if any, must be undertaken to ensure <br />that the project will not have a significant impact upon the <br />environment. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1.
