CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-337 <br /> <br /> A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DOMAIN <br /> PROPERTY NEEDED FOR THE EXTENSION OF BERNAL AVENUE <br /> <br />WHEREAS, to facilitate improvement to the traffic circulation <br /> system necessary for the central business district and <br /> to complete the planned circulation system of the <br /> General Plan for Pleasanton, a plan for the extension of <br /> Bernal Avenue west to cross the Santa Fe Pacific <br /> Railroad right-of-way; and <br /> <br />WHEREAS, implementation of the extension of Bernal Avenue <br /> requires acquisition of private property; and <br /> <br />WHEREAS, notice was given pursuant to Section 1245.235 of the <br /> Code of Civil Procedure of the State of California and a <br /> hearing was held at which time persons affected had an <br /> opportunity to appear and be heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council finds that, pursuant to Section <br /> 37350.5 of the Government Code of the State of <br /> California authorizing the City of Pleasanton to acquire <br /> property by eminent domain, all that land described in <br /> Exhibit "A", attached hereto is necessary for public use <br /> as a public street. <br /> <br />Section 2: The City Council declares that, with respect to the <br /> proposed extension of Bernal Avenue, it has found and <br /> determined that: <br /> <br /> a. the public interest and necessity require the <br /> proposed project; <br /> <br /> b. the proposed project is planned and located in the <br /> manner that will be most compatible with the <br /> greatest public good and the least private injury; <br /> <br /> c. the property described in this resolution is <br /> necessary for the proposed project; and <br /> <br /> d. an offer to acquire the property, meeting the <br /> requirements of Government Code Section 7267.2, has <br /> been made to the owner of record. <br /> <br /> <br />
