CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 86-337 A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DOMAIN PROPERTY NEEDED FOR THE EXTENSION OF BERNAL AVENUE WHEREAS, to facilitate improvement to the traffic circulation system necessary for the central business district and to complete the planned circulation system of the General Plan for Pleasanton, a plan for the extension of Bernal Avenue west to cross the Santa Fe Pacific Railroad right-of-way; and WHEREAS, implementation of the extension of Bernal Avenue requires acquisition of private property; and WHEREAS, notice was given pursuant to Section 1245.235 of the Code of Civil Procedure of the State of California and a hearing was held at which time persons affected had an opportunity to appear and be heard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council finds that, pursuant to Section 37350.5 of the Government Code of the State of California authorizing the City of Pleasanton to acquire property by eminent domain, all that land described in Exhibit "A", attached hereto is necessary for public use as a public street. Section 2: The City Council declares that, with respect to the proposed extension of Bernal Avenue, it has found and determined that: a. the public interest and necessity require the proposed project; b. the proposed project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury; c. the property described in this resolution is necessary for the proposed project; and d. an offer to acquire the property, meeting the requirements of Government Code Section 7267.2, has been made to the owner of record.
