PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 188$ <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON RECOMMENDING APPROVAL OF CASE <br />PUD-80-5 FILED BY JOSEPH MADDEN. <br />WHEREAS, Joseph Madden has applied to rezone a 2 acre site located <br />at 3851 Vineyard Avenue from the RM-1500 (Multiple-Residential) <br />District to the PUD-Residential (Planned Unit Development- <br />Residential) District and for development plan approval for <br />a 48-unit condominium complex to be located behind the <br />existing duplex on the site; and <br />WHEREAS, a public hearing was held on June 11, 1980 at which time <br />all pertinent reports, documents and testimony were reviewed. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission recommends approval of the <br />development and rezoning subject to the following conditions: <br />1. That the development be substantially as shown on the <br />'' development plan, Exhibit A, on file with the Planning <br />Division except that the Vine Street right-of-way <br />be shown as 50 ft., the entry trellis be removed and <br />the turn around on Vine Street be eliminated in order <br />to provide additional open space. <br />2. That the applicant be aware that this project will be <br />subject to further requirements under the Fire Code. <br />The applicant should contact the Fire Prevention <br />Bureau for further information. <br />3. That no building permits shall be issued for con- <br />struction of dwelling units on this site until a <br />vehicular connection has been made from Pico Avenue <br />to Stanley Boulevard. <br />4. That within one year, the applicant shall enter <br />into an agreement with the City to make a minimum <br />of 25$ of the units available to those of lower or <br />moderate income. The income limits and the percentage <br />of lower and moderate income units shall be established <br />as part of the agreement. Case PUD-80-5 shall not <br />become effective until this agreement has been exe- <br />cuted by the City Council with a prior recommendation <br />by the Planning Commission. <br />
