PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 1708 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON APPROVING A CONDITIONAL USE PERMIT FOR <br />H. C. ELLIOTT FILED UNDER UP-78-36. <br />WHEREAS, H. C. Elliott has applied for a conditional use permit to <br />allow the operation of a super market in the neighborhood <br />shopping center to be located at the southeast corner of <br />Tawny Drive and Pico Avenue. The site is zoned PUD/CN <br />(Planned Unit Development-Neighborhood Commercial Uses) <br />District; and <br />WHEREAS, a public hearing was held on January 10, 1979, before the <br />Planning Commission, at which time all pertinent reports, <br />documents and testimony were reviewed; and <br />WHEREAS, the Planning Commission made the findings: <br />A. That the proposed location of the conditional use is <br />in accord with the objectives of this chapter and the <br />purposes of the district in which the site is located. <br />B. That the proposed location of the conditional use and <br />the conditions under which it would be operated are <br />maintained and will not be detrimental to the public <br />health, safety or welfare or be materially injurious <br />to properties or improvements in the vicinity. <br />C. That the proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission approves UP-78-36, subject to <br />the following conditions: <br />1. That approval is granted for the market as shown on <br />the site plan for case UP-78-36, Exhibit A, on file <br />with the Planning Division. <br />2. That approval of this case is subject to all conditions <br />of Ordinance No. 866 approving PUD-78-3. <br />Section 2. This resolution shall become effective 15 days from the <br />date of passage and adoption. <br />
