PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1730 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING A USE PERMIT FOR W.R. GRACE <br />CORPORATION/BURGER KING FILED UNDER UP-79-06. <br />WHEREAS, W. R. Grace Corporation/Burger King has applied for a <br />conditional use permit to allow the construction and <br />operation of a drive-through service window at their <br />recently approved facility located on the east side of <br />Hopyard Road about 700 feet south of I-580. The site <br />is zoned C-F (Freeway Commercial) District; and <br />WHEREAS, a public hearing was held on April 11, 1979 before the <br />Planning Commission, at which time all pertinent reports, <br />documents and testimony were received; and <br />WHEREAS, the Planning Commission made the findings that: <br />A. The proposed location of the conditional use is in <br />accord with the objectives of this chapter and the <br />purpose of the district in which the site is located. <br />B. The proposed location of the conditional use and the <br />condition under which it would be operated or main- <br />tained will not be detrimental to the public health, <br />safety or welfare or be materially injurious to <br />properties or improvements in the vicinity. <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission approves UP-79-6, subject to <br />the following conditions: <br />1. That the development be substantially as shown on <br />the site plan, Exhibit A, on file with the Planning <br />Division. <br />2. That approval of this use permit is conditioned upon <br />Ordinance No. 878 becoming effective. <br />3. That the applicant submit a final landscape plan to <br />the Planning Division for approval prior to occupancy <br />and that all landscaping, according to the final plan, <br />be installed prior to final inspection. <br />4. That approval of this use permit is subject to all <br />conditions of approval of case Z-79-11 as set forth <br />in Design Review Board Resolution No. R-79-10 and <br />amended by City Council Resolution No. 70-36. <br />
