CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-323 <br /> <br /> RESOLUTION VACATING PORTION OF OLD HOPYARD ROAD (OWENS <br /> DRIVE) AND AUTHORIZING QUITCLAIM DEED FROM CITY <br /> <br /> WHEREAS, on July 15, 1986, the City Council received a staff <br /> report (SR 86:301) recommending the vacation of a <br /> portion of Old Hopyard Road (Owens Drive), more <br /> particularly described in the attached Exhibit "A"; and <br /> <br />WHEREAS, the proposed relocation of Hopyard Road is consistent <br /> with the goals and policies of the General Plan; and <br /> <br />WHEREAS, the superseded portion of Hopyard Road is no longer <br /> necessary for present or prospective public use due to <br /> relocation of the street westward; and <br /> <br />WHEREAS, access shall not be cut off to any person's property <br /> which, prior to relocation, adjoined the street being <br /> vacated; and <br /> <br />WHEREAS, no public service easements shall be terminated as a <br /> result of the proposed vacation; and <br /> <br />WHEREAS, public convenience and necessity require the reservation <br /> and exception of a public service easement over the <br /> entire roadway proposed for abandonment; and <br /> <br />WHEREAS, upon vacation of the right-of-way the appropriate use <br /> for the property is as plottage to be added to the <br /> adjacent property owner; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> relocation of Hopyard Road in a manner meeting the <br /> requirements of Section 8334 of the Streets and Highways <br /> Code, that portion of Hopyard Road described in Exhibit <br /> "A" is hereby vacated subject to the reservation and <br /> exception of a public service easement over the entire <br /> roadway to be vacated. <br /> <br />Section 2: The clerk shall cause a certified coy of the <br /> resolution of vacation to be recorded in the office of <br /> the Alameda County Recorder. <br /> <br />Section 3: Authorizes the Mayor to execute a Quitclaim Deed from <br /> the City of Pleasanton to The Prudential Insurance <br /> Company of America for the above-described property. <br /> <br /> <br />
