PLANNING COMMISSION CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO. 1772 A RESOLUTION APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF HENRY CUPPLES FILED UNDER PUD-79-6. WHEREAS, Henry Cupples has applied to rezone the 6.1 acre site located on the east side of Hopyard Road immediately north of the proposed Burger King restaurant from C-F (Commercial Freeway) District to PUD (Planned Unit Development-Commercial) District; and WHEREAS, the Planning Commission has held a public hearing to review this application on July 26, 1979; and WHEREAS, said proposal was based upon an Initial Study done pursuant to the Environmental Impact Guidelines and Procedures adopted by the City Council of the City of Pleasanton by Resolution No. 77-66; and WHEREAS, the Planning Commission, at its meeting of July 26, 1979 ~' received the Initial Study and proposed Negative Declaration in a report from the Director of Planning and Community Development dated July 26, 1979 regarding the aforementioned project; and WHEREAS, the Planning Commission was advised by the City Attorney of its responsibilities in reviewing the proposed Negative Declaration and the determinations required by Section 5.4(e) of Resolution No. 77-66; and WHEREAS, each member of the Planning Commission had before him/her copies of Resolution No. 77-66 at the time of considering the proposed environmental assessment, which has previously been published in the Pleasanton Times, at the time of the public hearing on the aforementioned project; and WHEREAS, upon receipt of the staff report and public input, the Planning Commission reviewed the provisions of the City's Guidelines and Processing Procedures for the evaluation of projects and preparation of Environmental Impact Reports as they pertain to requirements for Negative Declarations and Environmental Impact Reports in order to determine if a Negative Declaration is appropriate for the project and what mitigation measures, if any, must be undertaken to ensure that the project will not have a significant impact upon the environment.
