PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1772 <br />A RESOLUTION APPROVING A NEGATIVE DECLARATION <br />FOR THE APPLICATION OF HENRY CUPPLES FILED <br />UNDER PUD-79-6. <br />WHEREAS, Henry Cupples has applied to rezone the 6.1 acre site <br />located on the east side of Hopyard Road immediately <br />north of the proposed Burger King restaurant from C-F <br />(Commercial Freeway) District to PUD (Planned Unit <br />Development-Commercial) District; and <br />WHEREAS, the Planning Commission has held a public hearing to <br />review this application on July 26, 1979; and <br />WHEREAS, said proposal was based upon an Initial Study done pursuant <br />to the Environmental Impact Guidelines and Procedures <br />adopted by the City Council of the City of Pleasanton <br />by Resolution No. 77-66; and <br />WHEREAS, the Planning Commission, at its meeting of July 26, 1979 <br />~' received the Initial Study and proposed Negative Declaration <br />in a report from the Director of Planning and Community <br />Development dated July 26, 1979 regarding the aforementioned <br />project; and <br />WHEREAS, the Planning Commission was advised by the City Attorney <br />of its responsibilities in reviewing the proposed Negative <br />Declaration and the determinations required by Section <br />5.4(e) of Resolution No. 77-66; and <br />WHEREAS, each member of the Planning Commission had before him/her <br />copies of Resolution No. 77-66 at the time of considering <br />the proposed environmental assessment, which has previously <br />been published in the Pleasanton Times, at the time of <br />the public hearing on the aforementioned project; and <br />WHEREAS, upon receipt of the staff report and public input, the <br />Planning Commission reviewed the provisions of the City's <br />Guidelines and Processing Procedures for the evaluation <br />of projects and preparation of Environmental Impact Reports <br />as they pertain to requirements for Negative Declarations <br />and Environmental Impact Reports in order to determine if <br />a Negative Declaration is appropriate for the project and <br />what mitigation measures, if any, must be undertaken to <br />ensure that the project will not have a significant impact <br />upon the environment. <br />
