G. A dispute now exists between Utility and the City <br /> <br />as to the meaning of the above-referenced Dedication, <br />as well as the extent of special benefit, if any, which will <br />accrue to Utility as a result of the Valley Avenue Extension <br />Project. <br /> <br /> H. Utility is also concerned about the continued access <br /> <br />of commercial vehicles to and from the Property and the interstate <br />highway system once the Project is begun and is not satisfied <br />with the City's agreement with Kaiser Sand & Gravel Company for <br />access to the E1 Charro Route as set forth in the agreement between <br />the City and Kaiser as set forth in Exhibit "B" hereto, the terms <br />of which are incorporated by this reference as if set forth in <br />full herein. <br /> <br /> I. The City has further expressed a desire to acquire <br />approximately 1630.197 square feet of the Property for purposes <br />of the Project as set forth more particularly in Exhibit "C", <br />a copy of which is attached hereto and incorporated by this reference <br />as if set out in full herein. <br /> <br /> J. By reason of certain previous conditions and agreements, <br /> <br />Utility has, separate from its obligations, if any, to participate <br />in the Assessment District, an obligation to provide landscaping <br />for that portion of its property fronting on the proposed Valley <br />Avenue. A dispute now exists between Utility and the City as <br />to the extent of said obligation. <br /> <br /> <br />
