Agreement shall be executed in recordable form and may be recorded <br />with the Alameda County Recorder's Office by either party to <br />this Agreement. <br /> <br /> (d) Further Assurance· The parties agree that they <br /> <br />will, without further consideration, from time to time hereafter, <br />at their own expense, execute and deliver such other documents, <br />and take such other action, as may reasonably be requested in <br />order to more effectively consummate the transactions contemplated <br />hereby· <br /> <br /> (e) Severability· In case any provision of this Agreement <br />shall be invalid, illegal or unenforceable, the validity, legality <br />and enforceability of the remaining provisions of this Agreement <br />shall not in any way be affected or impaired thereby· <br /> <br /> (f) Incorporation· The Recitals to this Agremeent <br /> <br />and the Exhibits hereto are hereby incorporated herein as if <br /> <br />set forth here in full· <br /> <br /> (g) Attorneys' Fees· In case any action is brought <br /> <br />to enforce the terms of this Agreement, or for indemnity hereunder <br />as contemplated by paragraph 6(c) above, the party prevailing <br />in such action shall be entitled to recover such party's reasonable <br />attorneys' fees, as well as all other costs to such party in <br />connection with such action· Each party shall, however, bear <br /> <br /> <br />
