Ken Hammon
City of Pleasanton
June 19, 1986
Page Two

4. The policy will have a Street & Road Design Exclusion. Bodily Injury
& Property Damage will be excluded for losses arising out of the
rendering or failure to render any professional service in connection
with streets, roads, highways or bridges, including the preparing,
approving or failure to prepare or improve maps, drawings, opinions,
reports, surveys, change orders, designs or specifications, and
supervisory inspection or engineering services. The basic liability
policy had always been intended to exclude design losses. This
exclusion merely strengthens the already existing exclusion. The
existence of roads and streets is not excluded. The typical loss for
a municipality will continue to be covered, since they involve the
"existence" of roads and not the improper design. Supporting opinions
will follow.

5. We requested a higher self-insured retention for the liability coverage.
However, the carrier will not quote a higher retention on a city this
size.

We are relatively pleased at the renewal premium and form. The only two
changes of note are the Claims Made form and the road design exclusion. We
do not feel that these are serious restrictions in coverage. We have
requested a binder on the coverage effective 7/1/86 subject to your
approval.

Best regards,

COOPER MCKENZIE.MURPHY

Ben Fernandez

BF:mw
Encl.
