CITY COUNCIL OF THE CITY OF <br />PLEASANTON <br />ALAMEDA COUNTY <br />CALIFORNIA <br />ORDINANCE N0.840 <br />AN ORDINANCE REZONING <br />TO <br />ACCORDINGLY <br />ICIL OF THE CITY <br />DOES ORDAIN AS <br />Section 1. Rezones the parcel of <br />land approximately ten (10) acres in <br />size owned by Morrison Homes, lo~ <br />Gated between Hopyard Road and <br />Valley Avenue behind Alpha Beta <br />Shopping Center and indudmg both <br />sides of the future Northwayy RoaO <br />from RM~1500 and RM~2500 (High <br />Density Residentia0 District to PUD <br />(Planned Unit Development) Dis~ <br />trio, (as more particularly shown pn <br />Zoning Unit MaD No. I70 attached <br />hereto as Ezhibit A and incorporated <br />herein by reference) and approving <br />a development plan for said proper <br />ty. 5ublett [o the following condi- <br />tions: <br />1. That the development be sub- <br />stantially as shown on the develop <br />ment plan, Exhibit A, and the <br />materials, colors and textures <br />board, Ezhibit B. on file with the <br />Planning Department. <br />2. That in order to insure the Ci~ <br />ty's ability to monitor the flow into <br />the Sund Boulevartl Sewage Treat <br />ment Plant and to decrease the risk <br />of malfunctions to that facility, the <br />development shall be phased so that <br />none of the units are occuped dun <br />ing calendar year 1977 and no more <br />than 44 of the 78 units are occupied <br />during the 1978 calendar year. In no <br />event is appolicant guaranteed the <br />above specit1c units during 1978 or <br />any subsequent year. Applicant ac- <br />knowletlges that its project is suD~ <br />jest to any annual development <br />regulation which the City may adopt. <br />3. That each unit in the develop <br />meet have a separate water meter. <br />6. That there be no parking al~ <br />lowed on the south side of Northway <br />Road. <br />7. That the minimum site require <br />menu for this development De those <br />shown on the development plan ex~ <br />cept that the "basic floor area limit" <br />may be increasetl for patio covers <br />and accessory structures governed <br />by condition number 8 below. <br />8. That the applicant submit a <br />plan for the location of patty covers <br />and accessory structures, said plan <br />to be approved by the Planning De~ <br />partment prior to issuance of a <br />building permit. <br />9. That the developer be granted <br />the flexibility to interchange one and <br />two story units throughout the de- <br />velopment. <br />10. That all trees used in land <br />xaping be a minimum of l5 gallons <br />in size and all shrubs a minimum of <br />5 gallons. <br />11. That all utilities required to <br />serve this devdopment be installed <br />underground. <br />12. That the developer install <br />streets as required by ordinance. <br />13. Article l4, <br />Chapter 2, Title II of the Ordinance <br />Code of the Ciry of %easanton, the <br />City Council approves the Develop <br />ment %an considered concurrently <br />with the rezoning pursuant to Sec- <br />tion 1 above. <br />Secton 5. This ordinance shall <br />become effective thirty (30) days <br />after the date of its final passage <br />and adoption. <br />Section 6. That the developer construct <br />temteet wide sidewalk along the Vah <br />ley Avenue frontage to be used for <br />pedestrians and bicyclists and that <br />any landscaping of this area be <br />on <br />walk, and medians as may be re~ <br />paired in adtlition to the standard <br />street improvements of curb, gutter, <br />sidewalk, storm drainage facilities. <br />etc. <br />E.
