13 <br />THE CITY OF <br />i <br />pL£~S~4NTONo CITY COUNCIL AGENDA REPORT <br />1 <br />June 17, 2008 <br />Public Works Department <br />TITLE: DETERMINATION OF CONSISTENCY ON THE BERNAL PROPERTY <br />SPECIFIC PLAN FOR A PROPOSED WETLAND AND RIPARIAN <br />MITIGATION SITE <br />SUMMARY <br />The creation of wetland and riparian habitat is being required by various regulatory <br />agencies as mitigation to offset the temporary and permanent construction impacts <br />associated with the construction of the Bernal Avenue Bridge Project, CIP No. 995067. <br />Mitigation sites for the project have been identified both on-site and off-site. The off-site <br />mitigation area is proposed for the southwest corner of Valley Avenue and Laguna <br />Creek Lane, adjacent to Mission Creek on the Bernal Property (Attachment 1). Council <br />is being asked to make a finding that the use of this proposed off-site mitigation location <br />is consistent with the land use identified in the Bernal Property Specific Plan. <br />PARK AND RECREATION COMMISSION RECOMMENDATION <br />The Park and Recreation Commission met on June 12 and approved (5-0) the off-site <br />mitigation location on the Bernal Property and made a determination that the use of this <br />site for mitigation was in conformance with the Bernal Property Specific Plan. A <br />condition was added to provide public access to the site in the future with the addition of <br />two spur trails. <br />RECOMMENDATION <br />Make a finding that the creation of a wetland and riparian mitigation site for the Bernal <br />Avenue Bridge Project, CIP No. 995067, located at the southwest corner of Valley <br />Avenue and Laguna Creek Lane, is consistent with the Bernal Property Specific Plan. <br />FINANCIAL STATEMENT <br />There is no direct financial impact as a result of Council making a finding that use of this <br />site for mitigation is consistent with the Bernal Property Specific Plan. <br />
