BACKGROUND <br />On October 16, 2007, a Notice of Intent to Circulate Petition for the Initiative to Save <br />Pleasanton's Hills and Housing Cap was filed with the City Clerk. The proponents of the <br />Initiative turned in their petitions in April 2008. After conducting a random sampling <br />examination of the signatures on the petitions, the Registrar of Voters certified that the <br />petitions contained the required number of signatures needed to quality the Initiative. <br />The City Council at its May 20, 2008 meeting accepted the City Clerk's certification of the <br />petition and pursuant to section 9212 of the Elections Code ordered a report on the <br />effect of the proposed measure to be presented at the June 17 Council meeting. <br />DISCUSSION <br />Now that the City Council has received and discussed the report, it must do one of the <br />following: (a) adopt the initiative, without alteration within 10 days or (b) submit the <br />initiative, without alteration, to the voters at the next regular election. <br />If Council wishes to place the measure on the November 4, 2008 election, staff <br />recommends that Council direct staff to return at the Council's July 15 meeting with the <br />required resolutions calling for the election, setting the dates for direct and rebuttal <br />arguments, requesting the City Attorney to prepare an impartial analysis and ballot <br />question options. <br />Submitted by: <br />Karen Diaz <br />City Clerk <br />Legal Review: Approved <br />/~~ ~ ~ ~ <br />Michael H.
