PLANNING COMMISSION <br />City of Pleasanton <br />RESOLUTION NO. 1507 <br />A RESOLUTION OF THE PLANNING COMMISSION MAKING A MINOR MODIFICATION <br />TO UP-76-28. <br />WHEREAS, Larry Billings, owner of Casa Verde Garden Center, at <br />5511 Sunol Boulevard, has requested an interpretation of the Zoning <br />Code as to whether a swimming pool supply and service business is <br />similar enough to the types of uses generally found in a nursery to be <br />allowed as part of that use; and <br />WHEREAS, the property is zoned I-P (Industrial Park) District; and <br />WHEREAS, the Casa Verde Garden Center operation was approved as a <br />conditional use in said Industrial Park Zoning District; and <br />WHEREAS, the Planning Commission reviewed this request at their <br />March 9, 1977 meeting, at which time all pertinent documents, reports <br />and testimony were received by them; and <br />WHEREAS, the Planning Commission determined on March 9, 1977 that <br />"swimming pool supply and service" was similar enough to a nursery <br />use to be included in that category; and <br />WHEREAS, the consideration of this question raised several <br />_ problems related to the piecemeal method of development of the Casa <br />Verde Garden Center. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission makes a minor modification to <br />UP-76-28, by adding the following conditions: <br />a. That the sale of swimming pools is specifically prohibited <br />as part of the Casa Verde Garden Center operation. <br />b. That the applicant provide the Planning Commission with a <br />complete review of all present and intended uses on the subject <br />property. <br />c. That the Planning Commission be given an opportunity to <br />consider the overall appropriateness of said uses in the <br />I-P District. <br />Section 2. This resolution shall become effective 15 days follow- <br />ing passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City of <br />Pleasanton on the 9th day of March, 1977, by the following vote: <br />Ayes: Commissioners Doherty, Jamieson, <br />Shepherd, Wood, Chairman Butler <br />Noes: None <br />Absent: None <br />Abstain: None <br />Attest: Secretary Harris <br />
