PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1538 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF PLEASANTON DENYING WITHOUT <br />PREJUDICE CASE PUD-77-3. <br />WHEREAS, Morrison Homes, Inc., request a rezoning of two separate <br />noncontiguous parcels of property from RM-1500 and <br />RM-2500 Districts to PUD: a 10-acre site located be- <br />tween Hopyard Road and Valley Avenue behind the Alpha <br />Beta Shopping Center and including both sides of the <br />future Northway Road, and a 4.1 acre site located on <br />the northeast corner of Black Avenue and Hopyard Road; <br />and <br />WHEREAS, Morrison Homes sought concurrent approval of a development <br />plan only on the 10-acre site which would contain duplex <br />units; the gross density of which would be 7.5 units per <br />acre; and <br />WHEREAS, the General Plan shows the properties as high density <br />residential; and <br />WHEREAS, the Planning Commission held a public hearing on July 13, <br />1977, at which time pertinent maps, drawings, documents, <br />testimony and reports were reviewed; and <br />WHEREAS, the Planning Commission, in reviewing the request, <br />found that: <br />1. the two properties are noncontiguous to each other; <br />2. that the General Plan designation for each of the sites <br />is high density; <br />3. that the density for the proposed development on <br />the 10 acre parcel would not be consistent with the <br />high density designation of the General Plan; and <br />4. that combining densities on noncontiguous properties <br />in order to comply with General Plan density require- <br />ments is not an appropriate procedure under the <br />PUD District. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWING: <br />Section 1. The Planning Commission, denies, without prejudice, <br />PUD-77-3. <br />Section 2. The Planning Commission recommends that Morrison <br />Homes, Inc., apply for a general plan amendment for the <br />10-acre site located between Hopyard Road and Valley <br />
