PLANNING COMMISSION <br />CITY OF PLEASANT ON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION N0. 1553 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF PLEASANTON RECOMMENDING TO THE <br />CITY COUNCIL THE ADOPTION OF AN ORDINANCE <br />AMENDMENT FILED UNDER RZ-77-9 RELATING IN <br />PART TO HOT TUBS. <br />WHEREAS, the City has become aware tha-t hot tubs are becoming <br />increasingly popular in Pleasanton; and <br />WHEREAS, it was determined that these items are not properly <br />regulated by the Ordinance Code of the City and questions <br />have arisen with regard to their location in rear yards; <br />and <br />WHEREAS, hot tubs are not specifically listed in the Code and to date, <br />have been regulated as swimming pools; and <br />WHEREAS, because hot tubs are considerably different from swimming <br />pools, this interpretation has caused hardship in some <br />instances; and <br />WHEREAS, the City proposed to clarify the situation with regard to <br />hot tubs, and on August 10, 1977, the Planning Commission <br />reviewed a draft ordinance which would redefine swimming <br />pools so that it is clear that they are classified as <br />accessory structures and to remove them as permitted uses <br />in the R-1 and RM Districts, with the intent that they <br />would then be regulated as Class II accessory structures <br />from a siting standpoint. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. The Planning Commission recommends to the City Council <br />the adoption of an ordinance amending Sections 2-5.30(a), <br />2-5.44, 2-6.13, and 2-6.24 as described hereto in the <br />draft ordinance attached and incorporated by reference herein. <br />Section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br />
