PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 1555 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON INITIATING AN ORDINANCE <br />AMENDMENT PERTAINING TO ARTICLE 14 OF THE <br />ORDINANCE CODE OF THE CITY OF PLEASANTON. <br />WHEREAS, the recently revised PUD Ordinance of the City of Pleasanton <br />(Article 14) does not address itself to the question of <br />whether a PUD application may be filed on two or more non- <br />contiguous properties; and <br />WHEREAS, this matter arose in Case PUD-77-3, application of Morrison <br />Homes, Inc., for the rezoning and development of properties <br />located on Valley Avenue and Black Avenue; and <br />WHEREAS, it was the City Attorney's opinion with regard to that <br />case that the properties involved could not be considered <br />under the same application; and <br />WHEREAS, in order to make Article 14 clear with respect to this matter, <br />the Planning Commission, upon recommendation of staff, on <br />August 10, 1977, initiated an amendment to the PUD Ordinance <br />which would specifically state this prohibition. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. The Planning Commission initiates an ordinance amendment <br />which would prohibit consideration of two or more non- <br />contiguous properties under the same PUD application under <br />appropriate circumstances. <br />Section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED AND ADOPTED by the Planning Commission of the City of Pleasanton <br />on the 10th day of August, 1977, by the following vote: <br />
