EXHIBIT B <br />DRAFT CONDITIONS OF APPROVAL <br />PUD-99-01-05M, Steven and Suzanne Spencer <br />8031 Oak Creek Drive <br />May 20, 2008 <br />The swimming pool and related site improvements shall be substantially as <br />shown on the plans, Exhibit A, dated "Received June 18, 2007," on file at the <br />Planning Department, except as modified by the following conditions of approval. <br />Minor changes to the plans may be allowed subject to the review and approval of <br />the Director of Planning and Community Development if found to be in <br />substantial conformance to the approved exhibits. <br />2. Except as modified by the following conditions of approval, all conditions of <br />Cases PUD-99-01 through PUD-99-1-04M shall remain in full force and effect. <br />3. The applicant shall submit a grading and drainage plan that provides detailed <br />information regarding materials to be used to retain and provide positive <br />drainage, subject to the review and approval of the Director of Planning and <br />Community Development Department prior to the issuance of a building permit. <br />4. Existing Condition of Approval No. 8 of Case PUD-99-01 shall apply to 8031 Oak <br />Creek Drive (Lot 8) only and does not apply to the entire development. As <br />modified by the Planning Commission's recommended option below, the <br />condition shall be modified to read as follows: <br />"8. The minimum setback regulations for all main structures, Class I, <br />and Class II accessory structures on lots 1-12 shall be as follows: <br />Front <br />Yard <br />Lots 1,2, & 10 150 ft.ab <br />Lots 3-9, 11, & 12 23 ft.acd <br />Lot 8 23 ft.acd <br />Side Street Side Rear <br />Yard Yard Yard <br />25 ft.a 25 ft.a 20 ft.a <br />10 ft.acd 15 ft.ad 20 ft ad <br />*5 ft.acd 15 ft.ad *10 ft. ad <br />* The side yard setback shall be reduced from the required 10 feet to 5 feet and the rear <br />yard setback from the required 20 feet to 10 feet for Lot 8 only. <br />a Structure located outside an approved building envelope shown on the <br />approved tentative map shall follow the natural grade and cut and fill shall be <br />limited to less than three feet in height. <br />b The setback shall be measure from the westerly edge of the Foothill Road <br />edge of pavement as established by the approved interim alignment plan. <br />c 20-foot minimum front yard setback for side entry garages. <br />d On Lots 3,4, and 6, no structures, including additions, may be placed in the <br />"structure setback" area as designed on Exhibit A. <br />{end} <br />
