CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 86-246 <br /> <br /> RESOLUTION ESTABLISHING UNDERGROUND UTILITY DISTRICT <br /> 86-1, HOPYARD ROAD BETWEEN VALLEY AVENUE AND BLACK <br /> AVENUE <br /> <br /> WHEREAS, at its meeting of October 15, 1985, Council set the <br /> width of Hopyard Road from Valley Avenue to Black Avenue <br /> at four travel lanes; and <br /> <br /> WHEREAS, prior to construction of Hopyard Road utility poles and <br /> overhead wires must be removed and formation of <br /> Underground Utility District 86-1 is a logical extension <br /> of existing underground areas and is directly related to <br /> the proposed Hopyard Road construction; and <br /> <br />WHEREAS, because there are no other property owners affected <br /> within the district, no public hearing was necessary; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby finds and determines that the <br /> public necessity health, safety, and welfare require the <br /> removal of poles, overhead wires and associated <br /> structures, and the underground installation of wires <br /> and facilities for supplying electric, communication, or <br /> similar or associated service on both sides of Hopyard <br /> Road between Valley Avenue and Black Avenue, such <br /> described are is hereby established as Underground <br /> Utility District No. 86-1. Attached hereto, marked <br /> "Exhibit A," and hereby incorporated as part of this <br /> resolution, is a map delineating the boundaries of said <br /> District. <br /> <br />Section 2: That the City Council hereby makes the following <br /> further findings with regard to Underground Utility <br /> District No. 86-1: <br /> <br /> 1. The undergrounding to be accomplished pursuant to <br /> this resolution will avoid or eliminate an <br /> unusually heavy concentration of overhead <br /> distribution facilities. <br /> <br /> 2. The streets, roads and rights-of-way in the <br /> District are extensively used by general public and <br /> carry a heavy volume of pedestrian and vehicular <br /> traffic. <br /> <br />Section 3: That the following exceptions in said Underground <br /> Utility District No. 86-1 be and are hereby authorized <br /> <br /> <br />
