Motion: It was m/s by Sullivan/Thorne to approve the Transition Plan for compliance with the <br />American Disabilities Act. Motion passed by the following vote: <br />Ayes: Councilmembers McGovern, Sullivan, Thorne, Mayor Hosterman <br />Noes: None <br />Absent: Councilmember Cook-Kallio <br />COUNCIL REPORTS -None. <br />MATTERS INITIATED BY COUNCIL <br />Councilmember McGovern suggested having a computer setup for the public for PowerPoint <br />presentations. She discussed construction and demolition waste, said she toured the Alta Monte <br />Landfill, the goal for 75% diversion, confirmed with City Manager Fialho that the Waste <br />Management Committee met to discuss recycling programs, and that a draft ordinance would <br />be brought back in July or August which will incorporate diversion goals into the Municipal <br />Code. <br />Councilmember Sullivan noted that the City of Oakland established a ban on plastic bags, the <br />grocery bag industry sued and the ban was thrown out by Judge Frank Roche citing the need <br />for the City to conduct an EIR. <br />Councilmember Thorne said he will visit Sacramento to discuss the State Budget and requested <br />any input or requests be provided to him prior to his trip. <br />City Manager Fialho discussed agendas becoming increasingly impacted with neighborhood <br />appeals, said there are 3 or 4 in the next few months which take time away from agenda items, <br />and questioned Council's agreement in holding special meetings to address them. <br />Mayor Hosterman acknowledged the staff time it takes to address issues and accurately make <br />changes, questioned whether the appeal process could be amended such that more substantive <br />reasons for appeal might be incorporated into the process. City Manager Fialho said this topic, <br />along with others, is being reviewed by a committee, but will take another year. <br />Councilmember McGovern voiced concerns with holding additional meetings and the ability to <br />prepare for them. Councilmember Sullivan voiced concerns with limiting the rights of citizens in <br />the appeal process, and City Manager Fialho confirmed with the Council there was no support <br />for holding additional meetings.
