RESOLUTION NO. 08-194 <br />RESOLUTION AUTHORIZING ENTERING INTO AN AGREEMENT WITH THE <br />STATE OF CALIFORNIA AND DESIGNATING A REPRESENTATIVE TO SIGN <br />THE AGREEMENT AND ANY AMENDMENTS THERETO FOR <br />IMPLEMENTATION OF THE ABOVEGROUND PETROLEUM STORAGE <br />TANK ACT <br />WHEREAS, the people of the State of California have enacted the Aboveground <br />Storage Act Grant (ASPA) that provides funds to Certified Unified Program Agencies <br />(CUPAs) for establishing help to ensure facilities storing petroleum products do not <br />present an environmental hazard. <br />WHEREAS, the Livermore-Pleasanton Fire Department is the CUPA for the <br />cities of Livermore and Pleasanton. The CUPA has been delegated the responsibility <br />for the administration of the program within the state; and <br />WHEREAS, the Cities of Pleasanton and Livermore will enter into an agreement <br />with the State of California for grant funding for the implementation of an Aboveground <br />Petroleum Storage Act Program; and <br />WHEREAS, the City Council of the City of Pleasanton authorizes the submittal of <br />an application to the State of California for an Aboveground Petroleum Storage Tank <br />Act Grant; and <br />WHEREAS, the City Manager, or designee, is authorized to execute all <br />necessary applications, contracts, payment requests, agreements and amendments for <br />the purposes of securing grant funds and to implement and carry out the purposes <br />specified in the grant application; and <br />WHEREAS, that on May 20, 2008 at 7:00 p.m. at the Pleasanton Council <br />Chambers, 200 Old Bernal Avenue, Pleasanton, the City Council considered the <br />application for the Aboveground Petroleum Storage Act grant. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br />THE FOLLOWING: <br />SECTION 1. The City Council authorizes the submittal of an application to the <br />State of California for an Aboveground Petroleum Storage Tank Act grant. <br />SECTION 2. The City Manager, or designee, is authorized to execute all <br />necessary applications, contracts, payment requests, agreements and amendments for <br />the purposes of securing grant funds and to implement and carry out the purposes <br />specified in the grant application. <br />
