the property to be sold may be rescinded by Property Owner if, <br />after the filing of the notice of default and before the sale, <br />Property Owner performs the obligations described herein as well <br />as reimburses City for all costs, fees, and expenses of bringing <br />this action. <br /> <br />VI. ATTORNEY'S FEES <br /> <br /> If City commences an action against Property Owner arising <br />out~of or in connection with this agreement, City shall be <br />entitled to have and recover reasonable attorney's fees and costs <br />of suit. <br /> <br />VII. NOTICE <br /> <br /> Any notice or communication required or provided for under <br />this agreement shall be given in writing and sent by ordinary <br />mail to the following addresses: <br /> <br /> CITY: City of Pleasanton <br /> P. O. Box 520 <br /> Pleasanton, CA 94566 <br /> <br /> PROPERTY OWNER: Darrell and Jeanne Packard <br /> 943 Rose Avenue <br /> Pleasanton, CA 94566 <br /> <br /> Any notification required to be made by the City Engineer <br />shall also be sent to the party shown as the property owner on <br />the latest equalized assessor's roll. Any party or successor in <br />interest may change the foregoing address by giving notice of a <br />new address to each other party in the manner herein provided. <br />Notice shall be considered received two days after the time of <br />mailing. <br /> <br />VIII. SUCCESSORS IN INTEREST <br /> <br /> This agreement shall run with the land and be binding upon <br />any and all heirs, assigns, and successors in interest of <br />Property Owner having an interest in the property described in <br />Exhibit "A". <br /> <br />IX. RECORDATION <br /> <br /> This agreement shall be recorded in the Office of the <br />County Recorder of Alameda County. <br /> <br />X. RELEASE OF LIEN <br /> <br /> City shall execute and deliver to Property Owner upon <br />satisfactory completion of the work, upon Property Owner's <br />request, a quitclaim deed or other legal instrument, in <br />recordable form, which removes this agreement from title to the <br />site. <br /> <br /> - 3 - <br /> <br /> <br />
