the property to be sold may be rescinded by Property Owner if, after the filing of the notice of default and before the sale, Property Owner performs the obligations described herein as well as reimburses City for all costs, fees, and expenses of bringing this action. VI. ATTORNEY'S FEES If City commences an action against Property Owner arising out~of or in connection with this agreement, City shall be entitled to have and recover reasonable attorney's fees and costs of suit. VII. NOTICE Any notice or communication required or provided for under this agreement shall be given in writing and sent by ordinary mail to the following addresses: CITY: City of Pleasanton P. O. Box 520 Pleasanton, CA 94566 PROPERTY OWNER: Darrell and Jeanne Packard 943 Rose Avenue Pleasanton, CA 94566 Any notification required to be made by the City Engineer shall also be sent to the party shown as the property owner on the latest equalized assessor's roll. Any party or successor in interest may change the foregoing address by giving notice of a new address to each other party in the manner herein provided. Notice shall be considered received two days after the time of mailing. VIII. SUCCESSORS IN INTEREST This agreement shall run with the land and be binding upon any and all heirs, assigns, and successors in interest of Property Owner having an interest in the property described in Exhibit "A". IX. RECORDATION This agreement shall be recorded in the Office of the County Recorder of Alameda County. X. RELEASE OF LIEN City shall execute and deliver to Property Owner upon satisfactory completion of the work, upon Property Owner's request, a quitclaim deed or other legal instrument, in recordable form, which removes this agreement from title to the site. - 3 -
