ATTACHMENT2 <br />CONTRACT <br />GINGERBREAD PRESCHOOL PLAY YARD RENOVATION <br />PROJECT NO. 067015 <br />THIS CONTRACT is made and entered into this 3`d day of June, 2008, by and <br />between McNabb Construction, ("Contractor"), whose address is 3286 Gloria Terrace, <br />Lafayette, CA 94549 and telephone number is (925) 935-4200, and the CITY OF <br />PLEASANTON, a municipal corporation ("City"). <br />WITNESSETH: <br />WHEREAS, the City has awarded to the Contractor a contract for the <br />Gingerbread Preschool Play Yard Renovation, Project No. 067015. <br />NOW, THEREFORE, in consideration of the mutual promises set forth herein, <br />the parties agree as follows: <br />Work to be Performed. <br />This project includes all labor, materials, tools and equipment necessary for the <br />complete re-construction of the Gingerbread Preschool play yard, including: <br />demolition, storm drainage, grading, paving, installation of play apparatus, <br />fencing, landscaping, and other improvements described by these specifications <br />and shown on the project drawings titled: "Gingerbread Preschool Landscape <br />Drawings." <br />Said work is more particularly shown in the following documents, which are on <br />file with the Department of Public Works of the City and are incorporated herein <br />by this reference: <br />A. Approved Plans and Specifications entitled the Gingerbread <br />Preschool Play Yard Renovation, Project No. 067015, and <br />addenda thereto, if any. <br />B. Contract Change Orders approved by the City Engineer, done in <br />accordance with the Standard Specifications. <br />C. The elements of the proposal submitted to the City by the <br />Contractor, which the City has accepted. <br />2. Compensation. The City shall pay the Contractor for work actually performed at <br />the unit prices set out in the Contractor's proposal to the City. The quantities of <br />
