if unpaid at the close of escrow; (ii) those exceptions to title <br /> disclosed in the Preliminary Report issued by Northwestern Title <br /> Company dated October 8, 1985, Order No. 87818; and (iii) any <br /> agricultural leases as described in Section 9 herein. <br /> <br /> ~7. Time of Conveyance. <br /> <br /> (a) Owner shall convey the Property to City, or its <br /> assignee, at such time as designated by City, but in no event <br /> later than September 1, 1986. <br /> <br /> (b) Owner shall convey the Sanitary Sewer Easement to <br /> City, or its assignee, at such time as designated by City, <br /> said conveyance to be prior to actual installation of the <br /> sewer line and at the time the final location of said ease- <br /> ment has been fixed. <br /> <br /> 8. Fees and Title Insurance. City shall pay all escrow and <br />recording fees incurred in this transaction and, if title in- <br />surance is desired, the premium charged therefor. <br /> <br /> 9. Agricultural Use of Property. city recognizes that the <br />Property and Sanitary Sewer Easement may be subject to agricul- <br />tural lease(s) and use. City agrees to cooperate with the <br />agricultural tenant in scheduling development of the Property and <br />installation of the sanitary sewer line to allow harvesting and <br />planting to take place with a minimum of interference, but con- <br />sistent with City's development of the Property.
